SCOTUS Moots NY Gun Case, but Pending Cases May Provide Protection

Justice Brett Kavanaugh was among the SCOTUS judges that shot down the NY gun case.
U.S.A. -(AmmoLand.com)- While the U.S. Supreme Court has mooted the New York State Rifle & Pistol Association’s challenge of a now-defunct handgun law in the City of New York, there is a possibility for an important Second Amendment ruling coming from one of four cases now pending before the high court, the Second Amendment Foundation said today.
The hint came in a concurrence on the court’s decision from Justice Brett Kavanaugh. While he shares concerns voiced by Associate Justice Samuel Alito that some state and federal courts may not be properly applying the principles of the Heller and McDonald rulings.
“The court should address that issue soon,” Justice Kavanaugh observed, “perhaps in one of the several Second Amendment cases with petitions for certiorari now pending before the Court.”
While SAF founder and Executive Vice President Alan M. Gottlieb was disappointed, but not surprised by the high court’s action on the New York Case, he is encouraged that one of SAF’s four cases now up for consideration by the Supreme Court may be granted a hearing.
“The Second Amendment Foundation currently has four cases pending before the Supreme Court that could serve that purpose,” Gottlieb said, “and we hope that one or all of these cases gets heard and gives notice to lower courts that they can no longer thumb their noses at the prior rulings that protect Second Amendment rights.”
The four SAF cases already submitted to the high court are Rodriguez v. City of San Jose; Pena v. Cid, Culp v. Madigan and Mance v. Barr. The Mance case involves SAF’s sister organization, the Citizens Committee for the Right to Keep and Bear Arms as a plaintiff.
“SCOTUS mooted the New York case as the old law is no longer valid,” Gottlieb remarked, “but invited hearing another case pending before the high court to insure that lower courts adhere to the Heller and McDonald rulings made previously by the high court. We’ve got four ready-made cases now on the table just waiting for acceptance.”

A new game just came out called Valorant and on Twitch alone had over 1.7 million viewers the first day and has held the #1 spot ever since. So far in April it has a total of 261 million hours watched.
Only a few people have access to the game currently and 2AGaming is one of those.
People Care About Their Rights More Than Ever
With the lockdowns spreading across the country more people are watching what lawmakers are doing in terms of their freedoms. As you might have seen in the past month we have seen numerous attacks on the Second Amendment during a time that more people than ever before are looking to exercise their rights.
Video game streams are a great way to help draw in a younger audience and help educate them on what rights they have as well as why those rights are important.

SAF Sues Georgia County, Judge Asserting Deprivation of Rights

The Second Amendment Foundation is pursuing legal action against Cherokee County and Probate Court Judge Keith Wood.
Bellevue, WA -(AmmoLand.com)- The Second Amendment Foundation and Firearms Policy Coalition today filed suit in federal district court in Georgia, in a case alleging Cherokee County and Probate Court Judge Keith Wood have violated the constitutional rights of citizens by ordering that the county would not accept applications for Weapons Carry Licenses during the coronavirus outbreak.
SAF and FPC filed the action in the U.S. District Court for the Northern District of Georgia, Atlanta Division, on behalf of one of their members, Lisa Walters. According to the 16-page federal complaint, Walters’ husband contacted the probate court several days ago to inquire about her ability to obtain a carry license. The county informed Walters’ husband that the order to not accept license applications will remain in effect.
The case is known as Walters v. Wood. Plaintiffs are represented by attorney Adam Kraut of Sacramento, Calif.
“This is the most recent in a series of legal actions we’ve had to file around the country,” noted SAF founder and Executive Vice President Alan M. Gottlieb, “because we’ve discovered that some officials have arbitrarily decided the COVID-19 crisis allows them to suspend the Constitutional rights of the citizens they serve. We’ve been stunned by this pattern because such actions are not permitted by the Constitution. Authorities may not, by decree or otherwise, enact or enforce a suspension or deprivation of constitutional liberties.”
FPC President Brandon Combs concurred, stating,
“The Constitution explicitly protects the fundamental human right to bear arms, especially for self-defense. Governments cannot eliminate the right of law-abiding adults to
carry handguns for self-defense in public, which is all the more pertinent in these troubled times. As the Supreme Court has already explained, the Constitution’s guarantee of the right to bear arms is especially important for self-defense in case of confrontation, and individuals must be allowed to exercise their rights outside their home.”

Gun Rights Groups Sue New Mexico Gov., Challenging Emergency Order
BELLEVUE, WA – -(AmmoLand.com)- The Second Amendment Foundation, National Rifle Association and Firearms Policy Coalition today filed a federal lawsuit against New Mexico Gov. Michelle Lujan Grisham, challenging her order mandating the closure of lawful retail firearms businesses during the ongoing coronavirus pandemic.
Joining SAF, NRA and FPC are the New Mexico Shooting Sports Association, two businesses, and three private citizens. They are represented by attorneys Patrick J. Rogers, Albuquerque; Cody J. Wisniewski, Lakewood, Colo.; Adam Kraut, Sacramento, Calif., and Michael T. Jean, Fairfax, Va. The complaint was filed in U.S. District Court for the District of New Mexico and is known as Aragon v. Grisham.
In addition to Gov. Grisham, also named as a defendant is Kathyleen Kunkel, secretary for the New Mexico Department of Health, both in their official capacities. The Department of Health is also a defendant.
The lawsuit “challenges Defendants’ mandatory shuttering of lawful retail firearms businesses.”
“By arbitrarily, capriciously—and unconstitutionally—targeting those who lawfully sell firearms and ammunition, New Mexico is depriving citizens of their natural and fundamental right to keep and bear arms,” the complaint alleges.
“Gov. Grisham simply can’t suspend the Second Amendment,” stated SAF founder and Executive Vice President Alan M. Gottlieb. “Of course there is an emergency, but such emergencies do not nullify the Constitution, even temporarily. We cannot allow public officials to put their personal agendas above the rights protected by the Constitution, and that includes the right of the people to keep and bear arms.”
“The government has no duty to protect you and coronavirus-related impacts to law enforcement could be significant,” added FPC President Brandon Combs, “so times like now are precisely when people must be able to acquire self-defense tools to defend their lives and homes. We are proud to participate in this important case to defend the People’s right to keep and bear arms against government abuses in New Mexico.”
“Unfortunately,” Adam Kraut, FPC Director of Legal Strategy observed, “we find ourselves having to litigate yet another case where government officials believe that a crisis creates an exception to an enumerated constitutional right. We are happy to join with our friends from various organizations to defend the People of New Mexico’s right to keep and bear arms.”

N.J. Gov. Murphy Hit with Federal Lawsuit by Second Amendment Foundation

The Second Amendment Foundation has filed a federal lawsuit against New Jersey Gov. Phil Murphy over an executive order that has shut down gun sales in the state.
U.S.A. –-(Ammoland.com)- Several days after the Second Amendment Foundation warned the Mayor of New Orleans against suspending firearms sales in reaction to the COVID-19 outbreak, that organization has hit the New Jersey governor with a federal lawsuit alleging depravation of rights for “shutting down firearms dealerships in the Garden State, thus preventing citizens from exercising their rights under the Second and Fourteenth amendments.”
It may be the first time in history for such a legal action, as panic over the Coronavirus continues.
SAF is joined by the New Jersey Second Amendment Society, on behalf of Robert Kashinsky and Legend Firearms, a gun shop in the state. They are represented by noted civil rights attorney David Jensen at Jensen & Associates in Beacon, N.Y. He is also representing SAF and the Connecticut Citizens Defense League in a federal lawsuit against the state of Connecticut’s prohibition on so-called “high capacity magazines.”

In the New Jersey case, Gov. Phil Murphy and State Police Supt. Patrick J. Callahan are defendants in their official capacities. The complaint, filed in U.S. District Court for the District of New Jersey, alleges depravation of rights under 42 U.S.C. § 1983. The case is known as Kashinsky v. Murphy. The complaint may be read here.
The lawsuit contends that Murphy, by issuing Executive Order 107 on March 21, mandated “the closure of all retail businesses that sell firearms or ammunition and of making the portal for firearms background checks unavailable on the website of the New Jersey State Police…amount to a ban on obtaining firearms or ammunition in the State of New Jersey.”
Kashinsky, according to the federal complaint, does not own a firearm, but he recently obtained a Firearms Purchaser Identification card for the purpose of buying a gun out of concern for his ability to protect himself and his wife in the event of an emergency. However, Murphy’s executive order was quickly followed by a notice posted on the State Police background check portal of its website “indicating that the State Police would no longer conduct background checks,” the lawsuit says.
“Gov. Murphy cannot simply suspend the Second Amendment, and neither can Supt. Callahan,” said SAF founder and Executive Vice President Alan M. Gottlieb. “Yet, under this emergency order, that’s exactly what they’re doing. The Constitution, and federal law, don’t allow that.
“New Jersey may have been the first state to ratify the Bill of Rights,” Gottlieb observed. “but they’re the last state to recognize it.”
In 2005 following Hurricane Katrina, SAF and the National Rifle Association took the City of New Orleans to federal court over firearm seizures conducted by the administration of former Mayor Ray Nagin. The court found those gun confiscations—some of which were done at gunpoint—to be unconstitutional.
Recently, when North Carolina Gov. Roy Cooper declared a statewide emergency due to the Coronavirus, SAF reminded officials about the case of Bateman v. Purdue, that prevents suspension of Second Amendment rights during an emergency in that state. The intent was to allow people to venture outside their homes with firearms in the event of a disaster, such as a hurricane.
“We could not have foreseen that our case against North Carolina would ever keep citizens safe in this kind of emergency,” Gottlieb said, “but we are delighted that no public official can arbitrarily render the state’s residents unable to defend themselves on the grounds of a declared emergency. That’s the time when honest citizens might need their firearms the most while away from home.”
Just days ago, Illinois Gov. J.B. Pritzker signed an emergency order that actually exempts firearm and ammunition distributors and retailers from any shutdown, recognizing them instead as “essential businesses…for the purposes of safety and security.” SAF applauded the governor.
The New Jersey lawsuit could put other states on notice about trying to shut down the exercise of Second Amendment rights. Most state constitutions also have right-to-bear-arms provisions, and they are often more protective than the Second Amendment.

Illinois Gov. Sets Example For Others On Gun, Ammunition Stores

Illinois Governor J.B. Pritzker, When an anti-gun Democrat governor declares that essential businesses include firearm and ammunition suppliers and retailers for the purposes of safety and security, that is a really big deal.
BELLEVUE, WA — -(AmmoLand.com)- The Second Amendment Foundation today applauded Illinois Gov. J.B. Pritzker for including firearm and ammunition suppliers on the list of “essential businesses and operations” that will remain open during the Prairie State’s “Shelter-In-Place” emergency due to the ongoing COVID-19 Coronavirus emergency.
“When an anti-gun Democrat governor declares that essential businesses include firearm and ammunition suppliers and retailers for the purposes of safety and security, that is a really big deal,” said SAF founder and Executive Vice President Alan M. Gottlieb. “Every governor should copy the Illinois example when issuing ‘shelter-in-place’ and business closure orders in the face of the Coronavirus.”
Three other states are already under sweeping emergency orders as the nation copes with the Coronavirus pandemic. They are New York, Pennsylvania, and California.
“Depending upon how long this emergency continues,” Gottlieb observed, “many Americans may find themselves facing situations where they will need to be their own first responders. Gov. Pritzker obviously understands this, and we encourage the governors of all other states to recognize this isn’t an issue of party politics but of personal and community safety.”
Executive Order 2020-10 directs all individuals living within the state of Illinois to stay at home, except for “Essential Activities, Essential Government Functions, or to operate Essential Businesses and Operations.”
These include information technology equipment manufacturers and suppliers, hardware, food, cleaning supplies, and “firearm and ammunition suppliers and retailers for purposes of safety and security,” the order says.
“We are all in this together,” Gottlieb stated, “and we will make it through, together, as well. Stay safe, stay well and stay ready.”
